Terms of Service

These terms describe the rules for using Kinema. By creating an account or using the service, you agree to them.

Acceptance of terms

These Terms of Service ("Terms") form a binding agreement between you and Kinema. By creating an account, accessing the workspace, or using any part of the service, you agree to these Terms and to our Privacy Policy. If you use Kinema on behalf of an organization, you represent that you are authorized to bind that organization, and "you" refers to that organization. If you do not agree, do not use the service.

Accounts and eligibility

You must be at least 16 years old and able to form a binding contract to use Kinema. You agree to provide accurate account information, to keep your credentials secure, and to be responsible for all activity under your account. Notify us promptly at support@kinema.cc if you suspect unauthorized access. We may refuse, suspend, or reclaim accounts that violate these Terms.

The service

Kinema provides tools for planning, sourcing, editing, and rendering video projects. We may add, change, or remove features as the product evolves. We aim to keep the service available, but we do not guarantee uninterrupted or error-free operation, and we may perform maintenance or experience downtime.

Acceptable use

You agree not to use Kinema to: create or distribute illegal, infringing, defamatory, or deceptive content; impersonate others or misrepresent your affiliation; violate the rights or privacy of others; evade the policies of publishing platforms; upload malware or attempt to disrupt, reverse engineer, or gain unauthorized access to the service; scrape or resell the service; or generate content intended to harass, defraud, or deceive. You are responsible for your use and for the content you create and publish.

Credits, billing, and plans

Kinema is offered on credit-based and subscription plans. Generating, sourcing, and rendering consume credits according to the production mode and project you choose, and credits are tracked in your account ledger. Paid plans renew automatically for the stated term unless cancelled before the renewal date. Prices, credit costs, and plan features may change with reasonable notice; changes take effect on your next billing cycle. You authorize us and our payment processor to charge your payment method for all fees incurred.

Refunds and cancellation

You may cancel your subscription at any time from your account; cancellation stops future renewals and takes effect at the end of the current billing period. Except where required by law, fees and consumed credits are non-refundable, and unused credits do not carry value after account closure. If you believe you were charged in error, contact support@kinema.cc and we will review the request in good faith.

Your content

You retain ownership of the briefs, scripts, voiceovers, uploads, and other material you provide ("Your Content"). You grant Kinema a limited, worldwide, non-exclusive license to host, process, transmit, and display Your Content solely to operate and improve the service and to deliver the features you request. You represent that you hold the rights necessary for any material you upload or publish.

AI output and disclaimers

Subject to these Terms and your payment of applicable fees, you own the project outputs generated for you, to the extent such outputs are eligible for ownership under applicable law. AI-generated and AI-sourced material may be inaccurate, may resemble other works, and may not be protectable by copyright. You are solely responsible for reviewing outputs for accuracy, licensing, rights clearance, and compliance before publishing. Kinema does not guarantee that outputs are original, error-free, or fit for any particular purpose.

Copyright and DMCA

We respect intellectual property rights and respond to valid notices under the Digital Millennium Copyright Act and similar laws. If you believe content on Kinema infringes your copyright, send a notice to copyright@kinema.cc including identification of the work, the allegedly infringing material and its location, your contact information, a good-faith statement, and a statement under penalty of perjury that you are authorized to act. We may remove infringing material and terminate repeat infringers.

Intellectual property

Kinema, including its software, interface, branding, and documentation, is owned by Kinema and protected by intellectual property laws. These Terms grant you a limited, revocable, non-transferable right to use the service; they do not transfer any ownership in Kinema to you. Any feedback you provide may be used by us without obligation to you.

Warranty disclaimer

The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the service will be uninterrupted, secure, or that outputs will meet your expectations or be free of errors.

Limitation of liability

To the maximum extent permitted by law, Kinema and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill, arising out of or related to your use of the service. Our total liability for any claim arising out of these Terms or the service will not exceed the amount you paid to Kinema in the twelve months before the event giving rise to the claim.

Indemnification

You agree to indemnify and hold harmless Kinema and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of Your Content, your use of the service, your violation of these Terms, or your infringement of any third-party right.

Termination and suspension

You may stop using Kinema and close your account at any time. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure, or for prolonged inactivity, with notice where practicable. On termination, your right to use the service ends and we may delete your content in accordance with our Privacy Policy, subject to legal retention requirements.

Governing law and disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules. You and Kinema agree to first attempt to resolve any dispute informally by contacting legal@kinema.cc. Disputes that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, unless applicable law grants you the right to bring a claim in your local jurisdiction.

Changes to these terms

We may update these Terms as the product and our obligations change. When we make material changes, we will update the effective date below and, where appropriate, notify you in the product or by email. Continued use of Kinema after an update means you accept the revised Terms.
